ATG Credit Collection Agency Complaints

As of March 2017, the Better Business Bureau reported 98 closed ATG Credit complaints over the previous few decades, including 18 closed ATG Credit complaints over the past 12 months. The BBB provides ATG Credit an A+ rating.

According to the judge’s recommendation, the customer alleged that she enrolled for college courses, but withdrew from her classes a couple weeks later due to financial difficulties. She understood that she wouldn’t be responsible for tuition or other fees. Six decades later, the customer received a telephone call from ATG Credit stating that she owed a debt to the school. The first letter told her about her rights to dispute the debt, while the second letter stated that she must honor and pay the debt in a timely fashion…or else. The customer claimed this was an FDCPA violation because the contradictory nature of the letters confused her about whether or not she had 30 days to dispute the debt. ATG Credit claimed that it sent the second letter a complete month after the initial letter. The customer also promised that the debt collection agency didn’t provide the appropriate verification details. The judge agreed, and allowed the case to proceed.

December 30, 2015. Lemberg Law’s client says that ATG Credit called him to collect a supposed debt. He says that he told ATG Credit to stop calling him or else he would get the assistance of an attorney. Instead of politely following our client’s request, he claims that the ATG Credit employee he talked to said that ATG Credit didn’t “give a f***” what our client did.

People have different feelings about curse words. Some people use them often, while others never do. As an adult, you get to make those choices for yourself. However, we all know that there are times when foul language is never appropriate. One of those times is when you are a debt collector trying to collect a debt. In fact, not only is it improper to curse in that situation, it is also illegal.

Lemberg Law has recently filed suit on behalf of our client in U.S. District Court, Northern District of Georgia, charging ATG Credit with violating the Fair Debt Collection Practices Act (FDCPA) by engaging in harassing behavior; by using profane and abusive language; by causing our client’s phone to ring repeatedly and engaging him in conversation with the intent to annoy and harass him; and by using unfair and unconscionable means to collect a debt. It also charges ATG Credit with violating the Georgia Fair Business Practices Act. It asks for statutory damages of $1,000 for violating the FDCPA, plus other relief.

Understanding Your Debt Collection Rights

When it comes to debt collection agencies, the Fair Debt Collection Practices Act clearly defines which of the strategies are legal and which are online. By way of instance, a debt collection agency can contact someone who you know so as to obtain your contact info.     ATG has been fraudulently placing a debt collection on my credit preventing me from taking a Grad Plus student loan. The alleged debt was paid to my school CTU before graduation. CTU alleges that they told ATG that this debt was paid in full and was not supposed to go to collections. They recently added this on to my credit again this year. I would like to file a Tort case against ATG.
