Can ATG Credit Sue Me or Garnish My Wages?

It is illegal for a debt collector to make empty threats to sue you or garnish your wages. It is also unlikely ATG would sue you for a debt you may not owe or they cannot validate. However, debt collection agencies are known to have summoned debtors to court and garnish wages after a default judgement. Contacting an attorney BEFORE this could possibly happen would be a smart move. We’ve helped thousands of consumers fight back against unscrupulous debt collection harassers. Can you help me file a No Fee Lawsuit against ATG Credit?

Absolutely. You can sue a debt collector. Here are some Sample Complaints

Complaints against ATG Credit cite problems resulting from disputes about the validity of debts and the accuracy of information reported to the credit reporting agencies. In February 2019, a complainant stated that ATG had reported inaccurate information to the credit reporting agencies and had failed to verify any of the debts. According to the complainant,he received “an email alert from a credit reporting agency that his score had changed.” He checked his credit reports and saw “derogatory remarks on his account from a collections agency called ATG, which caused an almost 20-point drop in his credit score.” The complainant stated that he had “never heard of ATG before, …nor had he ever received any correspondence or communication of any form from them.” He also stated that he had no “notice of any debt owed and had no idea what this item pertains to…or what the claimed amount owed is.” The complainant stated that his “ credit report… says he has a balance of $4,276, with the highest balance at $2,787, which makes no sense to” him.His credit report also stated that he delinquent account was opened in September2018. However, he “usually checks his credit at least once a month and receives regular email notifications of changes to his score and last week was the first time this appeared on his credit report.” He insisted that “between last September and now, he had no communications from ATG regarding a debt owed…and that reporting the alleged debt to the credit reporting agencies and significantly damaging his credit was the first notification.” He requested “copies of all correspondence mailed…with proof of mailing,” and if “calls were made, … a call log…with identification of the number called and the dialing number,…so he can cross-reference it with his phone bill.” The complainant said he had “no idea what the underlying debt was …and was never provided with notification of the debt or an itemization/accounting of the debt, which is illegal under the FDCPA and Tennessee’s Consumer Protection Act.”

In response, ATG stated they had “previously responded to this complaint,” and that the “account is currently in a dispute status.” ATG insisted that they “did issue notification to the consumer.” The letter “was not returned and they… also made numerous attempts to reach the consumer via phone.” ATG said they were “waiting on documentation from the creditor” and had “verbally verified the balance,” but were waiting to “issue written proof to the address on file.” The complainant rejected the attempted resolution, insisting he had never received any “correspondence or phone calls or voice messages.” Although he had “asked for a copy of the letter that was allegedly mailed to” him, ATG had failed to provide a copy. As for his request for verification that they called his phone number, “the only response he had received from ATG is vague statements saying they mailed a letter and left messages with no actual proof of their doing so.” In its rebuttal, ATG stated that “the letters in question are automatically issued,” which “does not require human intervention and is completely automated.” They also insisted that they had “made a total of 14 calls,” none “of which were…responded to.”

December 30, 2015. Lemberg Law’s client says that ATG Credit called him to collect a supposed debt. People have different feelings about curse words. Some people use them often, while others never do. As an adult, you get to make those choices for yourself. However, we all know that there are times when foul language is never appropriate. One of those times is when you are a debt collector trying to collect a debt. In fact, not only is it improper to curse in that situation, it is also illegal.

Lemberg Law has recently filed suit on behalf of our client in U.S. District Court, Northern District of Georgia, charging ATG Credit with violating the Fair Debt Collection Practices Act (FDCPA) by engaging in harassing behavior; by using profane and abusive language; by causing our client’s phone to ring repeatedly and engaging him in conversation with the intent to annoy and harass him; and by using unfair and unconscionable means to collect a debt. It also charges ATG Credit with violating the Georgia Fair Business Practices Act. It asks for statutory damages of $1,000 for violating the FDCPA, plus other relief.

I have made arrangements to pay ATG a set amount per month, which I have been doing so. My last payment was last month, but yet they just sent me over to collections which I do not understand why considering I’ve been making my payment arrangements. I am extremely annoyed as I take my credit seriously and work hard to keep it in order. This has severely set me back

I injured my right elbow at AutoZone, they said I should go to the Doctor. I saw the Dr two times, then they denied it. I was billed $740, got an attorney, she settled for $940. By then ATG had it. Gallagher Bassett did not pay the medical bill. I’ve sent them paperwork showing the settlement, but it does no good. It has really damaged my credit.

I also have been contacted by this ATG place!!! What do I need to do to see if I have a case?

ATG has been fraudulently placing a debt collection on my credit preventing me from taking a Grad Plus student loan. The alleged debt was paid to my school CTU before graduation. CTU alleges that they told ATG that this debt was paid in full and was not supposed to go to collections. They recently added this on to my credit again this year. I would like to file a Tort case against ATG.
