In 2013, a judge in U.S. District Court, Western District of New York, denied Capital Management Services’ motion to dismiss Hunter vs. Capital Management Services for alleged violations of the Fair Debt Collection Practices Act and other legislation. The judge’s opinion said that the plaintiff owed a debt to Barclays Bank, which Barclays used Capital Management Services to collect it. Capital Management Services sent a letter to the customer that was characterized as a “settlement offer” and outlined a payment plan. The lawsuit alleged that the customer made the initial payment, but that Capital Management Services rejected following payments, basically revoking the settlement deal. The judge ruled that the customer’s allegation that withdrawing the settlement deal constituted a false or deceptive statement in violation of the FDCPA was enough to deny Capital Management Services’ motion to dismiss the case.
