What are my Background Check Disclosure and Consent Rights?

A Summary of Your Rights Under the FCRA

You have a right to know if an employer will use information from a background check against you and an employer cannot obtain background check information without your express written consent.

A background check company cannot hand over your information to an employer unless the employer certifies that: (1) it has “clearly and conspicuously” disclosed to you in a separate document that it may obtain a background check; (2) you have authorized it to get the background check; and (3) it will provide you with advance notice of any adverse action based in any part on the background check report, a copy of the report, and a summary of your rights under the FCRA.

What if I get an adverse action notice from an employer after a background check?

If an employer takes “adverse action” against you by denying you a job based partly or completely on information in a background check report, the employer must give you notice of that fact. The adverse action notice must include the contact information for the background check company and an explanation of your rights to dispute the report.

Can criminal convictions appear on my background check after 7 years?

Yes, but a background check company must take reasonable steps to ensure its report is as accurate as possible. The FCRA also puts limits on the negative information a job screening report can include. A report cannot list civil suits, judgments, arrest records, paid tax liens, accounts in collection or most other negative information after 7 years, or bankruptcies after 10 years. It also cannot list expunged convictions. However misdemeanor or felony criminal convictions that go on record and are accurate can stay on your background check indefinitely.

Can I dispute a false disposition on my background check report?

If you don’t get a job because of information in a background check report, you are entitled to a copy of the report. You also have the right to dispute the report if it has errors or includes information it shouldn’t. If you dispute a report, the background check company must investigate and correct any errors within 30 days.

Can I Sue Certiphi Screening if my background report includes errors?

    Certiphi will likely say they have not received verification on education/work history (after they reach out to you and you give them what they ask for). They are very slow and out of touch with how things actually work in the real world.

    They are the worst background checking agency I’ve ever had to go through! I’m currently fighting with them now to confirm information they said they would research. They just cost me a job opportunity and I’m going to do my best to expose them and their tactics! Terrible and unprofessional so called business.

    After I officially resigned from my current job, Certiphi took 5 weeks to run my background check and their report says I failed for three ridiculous reasons: (1) “The person is not on file with US Credit bureau” since they ran US credit on Canada based candidate. (2) Education end date differs from institution verification” I reported April 2013 as end date of all my classes and I uploaded my diploma that says June 10, 2013. April vs June should is not a valid reason to fail my education background check. (3) “Unable to verify previous employment (with a company from 7 years ago) and candidate did not provide supporting document (T4)” Certiphi misspelled the email address so their email was never sent out to the company they tried to reach, and email subject is: “Attention xxx reference check” but xxx no longer works at that company. I provided my T4 from that company from 7 years ago. Certiphi attached that T4 to my report but their comment somehow says: “candidate did not provide supporting document (T4)”.

    Kindred at Home is using Certiphi to perform motor vehicle checks on employees, however the information being asked of the employee is all about Background and credit. We are informed that this is NOT a background check and that none of the info gathered will be used as a Background check however all the info gathered is what is used during a Background check. We have been told this is mandatory and we could have problems with employment if we fail to comply. We have not been asked permission to have a background check performed(few would mind if we were informed we were getting a background check)but because of the lies the company has issued we are concerned.
    By the way, we have MVH every so often and it has never involved this level of information gathering.

    It been a month since the original background check and it was inaccurate results. I lost 1 job opportunity and they are about ruin another. I have been calling and nothing have change. I provided inforinform to help them complete their background check and nothing haven’t been done. I’m getting falsely accused for charges 1990 when I was a kid. How did I get many high risks jobs and this charge never appeared before?

    CERTIPHI IS TERRIBLE! I CANNOT STRESS THIS ENOUGH! THEY TAKE FOREVER TO GET THEIR BACKGROUNDS BACK AND THEY CLAIM THEY DO NOT RECEIVE VERIFICATIONS WHEN VERIFICATIONS HAVE BEEN SENT. HALF THE TIME I HAVE TO CALL AND VERIFY BECAUSE CERTIPHI IS NOT CAPABLE OF DOING IT.

    Recently lost out on a job opportunity due to Certiphi, using a dismissed charge against me as well as a loitering charge and also showing the original charge that was dropped down cause I wasn’t guilty of that. I also find the place of employment did not send me documentation of reason for not being hired as well.
