What is the Knapper v. Cox TCPA Class Action Settlement?
A $10.75 M settlement has been reached in a class action lawsuit alleging Cox Communications violated the Telephone Consumer Protection Act by using an automatic telephone dialing system to call numbers that appear on the National Do Not Call Registry and recipients who did not provide their consent.
The Settlement affects certain individuals who received automated calls between March 28, 2013 and March 21, 2019 from Cox. The Settlement Class excludes individuals who were ever Cox customers prior to March 22, 2019. The cable giant has maintained that it only calls consumers if they have previously given their consent but has decided that settlement is best for all parties involved.
If the Settlement is approved, Class Members will receive a pro rata share of the $10.75 million settlement fund which divided amongst all members could equate to a monetary award far more inferior than what filing an individual suit could result in.
After attorneys’ fees and expenses and lead plaintiffs’ incentive awards are deducted, remaining eligible persons would receive an estimated cash award of $100 to $300 based on a 10% claim rate, but could be less upon final approval.
