What is Davila-Lynch v. HOSOPO Corporation, et al. TCPA Class Action Settlement?

A $800,000 settlement has been reached in a class action lawsuit alleging Horizon Solar Power violated the Telephone Consumer Protection Act by using an automatic telephone dialing system to call consumers who were on the National Do Not Call Registry with pre-recorded messages. The Jeremiah Davila-Lynch class alleged Horizon Solar Power repeatedly relied on using an ATDS (Automatic Telephone Dialing System) to place thousands of unsolicited robocalls as part of its marketing strategy.

Horizon Solar Power denies any wrongdoing but has agreed to settle the class action lawsuit in the best interest of all parties.

The Settlement affects each of the members of the nationwide class who received unwanted automated telemarketing calls from Horizon Solar Power between Oct. 16, 2017 and Dec. 8, 2017.

If the Settlement is approved, affected Class Members will be eligible to receive pro rata share of the $800,000 million settlement fund which divided among all members could equate to a monetary award far more inferior than what filing an individual suit could result in.

After attorneys’ fees and expenses and lead plaintiffs’ incentive awards are deducted, remaining eligible persons would receive an estimated cash award of only $5 based on a 10% claim rate, and could be less upon final approval.
