Is Resurgent Capital Services a scam?

They’re legit. According to the Better Business Bureau (BBB), Resurgent Capital Services was founded in 1998. The BBB established a profile page for RCS in 2000. The BBB lists Resurgent Capital Services as a collection agency and have been BBB accredited since 2017. Buzzfile estimates RCS’s annual revenue at $96,000 and the size of its headquarters staff at 1 employee.

Who does Resurgent Capital Services collect for?

Resurgent Capital Services pursues payment from customers for a vast array of debts, such as credit card and health care debt. RCS collects on behalf of both original creditors and debt buyers. Can Resurgent Capital Services Sue Me or Garnish My Wages?

It is illegal for a debt collector to make empty threats to sue you or garnish your wages. It is also unlikely RCS would sue you for a debt you may not owe or they cannot validate. However, debt collection agencies are known to have summoned debtors to court and garnish wages after a default judgement. Contacting an attorney BEFORE this could possibly happen would be a smart move. We’ve helped thousands of consumers fight back against unscrupulous debt collection harassers. Resurgent Capital Services Calling You?

Federal laws protect you. The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

Can I sue RCS for harassment?

Yes. If you want to enforce your rights, or recover money for violations — you need to sue. Federal laws provide individuals like you with a means to seek monetary damages in court. For example, the FDCPA allows consumers who have been violated to recover damages of up to $1,000, plus attorney fees and court costs.

I just receive a text from them implying I owe a debit.. I believed it to be a phishing attempt and deleted the text message. I have absolutely no idea who they were till I googled them. I also receive a call from a Man who asked for the wrong name and proceeded to state they were going to prosecute me if I didn’t put this person on the phone..told this gentleman good luck!! He blatantly refused the company name but it was from South Dakota.. (reversed the number)..Must run the business from the trunk of their car and have no knowledge of FDCPA!!

I’ve sent a dispute letter to Resurgent Capital Services to both addresses, the last being to the P.O. Box on 10/23/2019 (Certified mail) and I have received another letter today stating that I have 30 days to dispute this debt. Do I have to send another dispute letter? Or what can be done about this? They have already put this on my credit report.

I’ve been contacted by these people stating I owe a debt but they never send any statements confirming the debt. They call 10+ times a day. I’ve received texts and asked to only be contacted by mail never got anything.

LVNV Funding (Resurgent) claims I owe credit card debt. I’ve sent letters asking for validation as well as cease and desist stating the only way they can contact me is in writing. They call my home and cell phone constantly with different phone numbers. They let the phone ring 2-3 times and then hang up without leaving a message. I keep blocking numbers but they just call back using a different one. I know it’s them because a few times I’ve called the numbers back and it’s always some Resurgent company that answers. I’m tired of their games. They don’t leave their info on the answering machines because they know they have a cease and desist order. Instead they hope i call back so they can try to collect money which they haven’t and can’t validate the debt. Something needs to be done as I know I can’t be the only one they do this to.

I have a credit card debt that was taken over by Resurgent , my balance is 540 and I made a payment of 90 dollars but nothing has changed on my credit report stating a payment or reduced balance. My question is, am I being scammed? Or will it stay on my credit report even after I pay off my debt…I haven’t received phone calls because they do not have my phone number but I have had numerous mail delivered to me stating a payment…now that I have paid nothing is being resolved.

Resurgent Capital Services has not released a judgement that was paid in full on 01-14-2009. I have a letter from them stating all of this. As a result of them NOT releasing the judgement with LA courts, My credit has suffered and I am in the middle of a refinance and now, it’s costing me thousands of dollars.

  • Maria S

I have been trying for close to a year to obtain validation of a debt from Resurgent; they have either refused to provide me the information or generated a document on their letterhead regarding the alleged debt while they continue to report this to the credit bureaus. I have told them numerous times not to contact me at work and today they contacted me twice at work.

I have sent them repeated requests beginning in February of 2018 on this matter and have received nothing and yet I have executed green cards that they received my information/request. This should not be; I am not going to pay on an alleged debt form 3 or 4 years ago without the proper information from the original company.

I called to make a payment of $1400.00 and wanted a fax sent to me stating the balance. They would accept the payment towards the $6336.00 debt, but refused to fax the statement. I wanted the statement to get and apartment. Once I get the apt. The house would be sold and I could pay the debt off. I need it faxed or I will lose my chance at this apartment, and I am disabled. My contact information is Pam D. 812-xxx-xxxx. Evansville Indiana. Thank you for your free service. Amazing.
