Is Sunrise Credit Services a scam?

According to the Better Business Bureau (BBB), Sunrise Credit Services, Inc. is a legitimate collection agency founded and incorporated in 1975. The BBB established Sunrise’s profile in 2000. Sunrise is listed under collection agencies, business processing optimization, and general business services. Buzzfile estimates Sunrise’s annual revenue at $34.5 million.

According to its website, Sunrise offers “customized programs for managing all of your receivables needs and collections as an extension of your own operations or on a standalone basis.” Since its founding in 1975, Sunrise has grown to become one of the largest Accounts Receivable Management (ARM) companies in the United States. Sunrise employs over 500 people at its 40,000 square-foot headquarters facility.

Sunrise Credit Services, Inc. is one of a family of three companies. NetTel USA, Inc., provides Business Process Outsourcing (BPO) services such as call center services and extended business office outsourcing for a variety of industries. Sunrise Capital Management, Inc., is a debt buyer that allows lenders from all industries to generate operating capital by selling off delinquent debt. Sunrise Credit Services provides third-party collection services for retailers, banks, and other credit grantors nationwide.

Sunrise employees are trained at the Sunrise Family of Companies University (SFCU), which is an internal, proprietary “training program modeled after a university curriculum by collection professionals with over 35 years of industry experience.” After 175 hours of coursework, “collection professionals are awarded a Certified Degree from SFCU.” However, Sunrise’s website does not contain any references or links to external consumer resources or state or federal laws such as the Fair Debt Collections Practices Act (FDCPA).

How many Complaints are there against Sunrise Credit Services?

The BBB has closed 109 complaints against Sunrise Credit Services in the past three years, with 55 of those complaints closed in the past twelve months. Almost all of these complaints alleged problems with billing and collections. There are also ten negative and two positive customer reviews. Since March 2015, the Consumer Financial Protection Bureau (CFPB) has closed 90 complaints against Sunrise alleging violations including attempting to collect debts not owed; making false statements; and improper disclosure of information. Justia lists at least 7 cases of civil litigation naming Sunrise as a defendant.

For the most part, the details of consumer complaints against Sunrise on the BBB website are unavailable. However, the CFPB website provides narratives of the consumer complaints it receives. In June 2017, the CFPB reports that a complainant indicated Sunrise began contacting him about a delinquent debt. The complainant indicated to Sunrise that the bill had been disputed with the New York State Attorney General and CFPB. The complainant indicated a Sunrise representative responded by stating “it was not their problem and to pay up.” The complainant indicated Sunrise continued to call several times a day despite a cease and desist request, and that calls had been increasingly aggressive and threatening, bordering on harassment. Also in June 2017, a complainant indicated Sunrise representatives had been “calling repeatedly from different phone numbers within minutes of each other.” Representatives called throughout the day asking for verification of personal information. The complainant indicated to Sunrise representatives when his pay day occurred, when he would be submitting payment, and requested that calls cease and desist until then, but the calls continued. The complainant also alleged that Sunrise representatives refused to send written correspondence. In May 2017, a complainant indicated Sunrise representatives had been “calling my home for a month a dozen times a day.” The complainant indicated that he had informed Sunrise that it was not his debt. Sunrise said his name and number would be removed from the calling list, but he soon began receiving calls again. Also in May 2017, a complainant indicated that Sunrise representatives had “been calling at least 4 times a day.” The complainant “asked them repeatedly to stop calling…at work,” but the calls persisted because Sunrise representatives complained that the consumer didn’t answer the phone after work. In all these cases, the CFPB has indicated that the “[c]ompany has responded to the consumer and the CFPB and chooses not to provide a public response.”

The Fair Debt Collections Practices Act (FDCPA) and the Fair Credit Reporting Act (FCRA) are enforced by the Federal Trade Commission (FTC) and the Consumer Financial Protection Bureau (CFPB). The FDCPA regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt.

The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA). The complaint above illustrates how these laws can be extremely effective tools to hold accountable collection agencies who fail to adhere to their provisions.

    We ordered Direct TV and I ask the man I was talking to if we would get a certain channel he checked and said yes. When they called to schedule appt. to install again if we would get this channel they said yes. When the installer came we ask him again he, he said yes. When he left we ran channels and did not have that channel. I called immediately and was put on hold for hours, when we finally got to talk to a supervisor we told her to just disconnect the service she said I will fix it and you will be billed the same amount. before the week was up we received a huge bill I called and told them to disconnect the service, I was informed that they would send a box and label to send the equipment back to them. We never received it, I called back and was told to take it to the nearest UPS store I did and they told me they couldn’t send it back without a label I would have to take it to Memphis (2 hours away) to mail it. I called again and ask for a box and label they said they could send a label I said fine I will find a box. I have still not received a label and have called at least twice since then. All we get from them is a bill which I do not feel that we owe. We did pay Direct TV the $85.00 that they say we owe, but AT&t is saying we owe $584.07 If you can help with this I would appreciate it.

  • Carlanda McKinney

    Has anyone else payed Sunrise and them not report it back to the creditor? I paid them over a year ago and the payment was never reported back to AT&T; now they’ve sent my account to another collection agency. When I spoke with them they said they only keep records for 3 months. I could have paid this account from 1 of a dozen cards so there’s not a lot of hope in me locating the payment. Any advice?
