Capital One Calling You?

Understanding Your Debt Collection Rights

Federal consumer protection laws are designed to protect consumers from unethical business practices. For example, the Fair Debt Collections Practices Act (FDCPA) and the Fair Credit Reporting Act (FCRA) regulate the way in which collection agencies can conduct business. The FDCPA’s provisions prohibit the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies.

Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA). The complaint above illustrates how consumers can assert their rights when financial services companies overstep their bounds.

These laws also provide individuals with a means to seek monetary damages in court. For instance, the TCPA provides monetary compensation to consumers who can prove harassment. In the case of willful harassment, this compensation can be increased three times. As a result, entities can be fined up to $500 if case harassment is proved. In case willful violation is proved, this compensation can be up to $1500.

Capital one calls up to 10 times a day even on the weekend. If you don’t answer they will call you from a different number. If you answer they won’t let you get off the phone unless you setup a payment date or pay on the phone. They told my wife that they have her card number on file and said they will just make the payment anyways. She got paid the next day and she told them that but was relentless on getting the payment.

I’m tired of them calling me several times a day

  • Lisa

  • Helen

People are falling on very hard times now with costs rising from the W.H., myself included. I do not need to be reminded daily of this or my past due c.c. bill from Capital One! They are getting pesty. I do not answer 800 #’s or ones I do not know. They don’t bother to leave any messages either. STOP THE CALLS, CAP ONE. when I have the money to make a payment, I definitely will. I don’t like debt either, but with no money, I can’t pay. Sorry, but eating is my top priority, healthwise.

Have been calling me twice a day for weeks. Leave a voicemail occasionally that just says call back to make arrangements but doesn’t identify who they are or for what arrangement.

  • JP

  • Sue W

Is 1-800-955-6600 allowed to use one of my local retailers as their identity when call comes thru? I know it’s not Fred Myers Store Redmond calling me ,it’s this collection company calling.

  • Stephanie p

They call me 10 or more times in a day. They even call on Sundays, at night, early morning. If I ask them to stop calling they do not so I even tried just telling them they have the wrong number and they said my number would be removed but yet I still get calls all day long from them.

In March of this year, I make a $6.99 purchase from a (now I know a Robo Co) on my (then) capital one card. I called Capital One when I received a bill for $392 from this company stating that I did not pay the $392 before the end of 15 days. I called Capital One in April and explained the problem. The gave me the phone # of this company and I called and said I wanted to cancel this and they me a cancellation #. I called Capital One and gave them the cancellation #. In May, I have letters from Capital One stating that they had credited my account. In June, I started getting bills again from Capital One. I called and they said they would look into this. In July, I called again and spoke to someone at Capital One and he got on the phone with someone from this company and they said, I wouldn’t get a refund because I cancelled it and didn’t return anything. I didn’t have anything to return from the sample. Capital One rep asked for a supervisor and she said they wasn’t one. I have the letters that Capital One said were taken care of. I sent them copies of these letters but they are still harassing me.

I got a call that said to please call CapitalOne at 1800-955-6600 about an important matter. I looked up the number on the internet searched and it showed itself to be CapOne spam. My account is in excellent shape. I called the number and the operator asked what it was about? When I told him about a call from CapOne, he said they don’t bother people with accounts that are up to date…and that is not a number they use. Huh! I checked the caller ID and told him that I got a call from that number and I am talking to him on that number. He hung up.

Received two robocalls today, one at 7:12am PT and one at 10:37am PT. The calls come from 772.212.0531, and an auto message is left to call 800.955.6600, but no one identifies the reason/purpose for the call.

In April I called Capital One and asked to speak to a representative to get my QuickSilver credit card straighten out. Amazingly, the woman I spoke to they have no record of where my late fees would be waived and I only owed $203.73, (yet have where that woman sent me to another trying to set me up on a program to help me on the account. I told the woman they transfer me to that no I just wanted to pay the account off and not deal with them.) I agreed to send it on May 3rd. She even gave me the address to notify the company to cancel my card and report it to the credit agencies I asked to have the card cancelled. Capital One Attn: Genral Correspondence po box 30285 Salt Lake City UT 84130-0285. She also told me to make sure in the memo part of my check to put my last 4 digits of my credit card and PAID IN FULL. The number I called was 1-866-953-7906. Since then I’ve spoken to several people at Capital one and got nothing but a run around. Rae,(?) sent me to Sharon, she sent me to a Jessica which I got hung up on in the transfer. Next call I made was to Ashley, transfer me to Jennifer said it would be investigated. Next call was to Karen who said there was no recording of late fees being made and my balance was $203.67. I told her filing a report with Attorney General and do not call me again about this matter. That night I get a call and Rianne tells me a case is submitted. Sept 6 I spoke to a Erica and told her not to call me anymore nor send me any more of their offers I want nothing to do with them. I was recording this . (when I looked I didn’t activate the mini recorder so that’s no good). and I was calling a lawyer. Hence why I’m contacting you. I’ve written down every time they called and recorded the time as well. To date there is 27 calls since May 2018. I’m on SSI Disability and on medication for my anxiety/depression for a couple years now. I did as the woman I spoke to in April said I owed, I did send my payment on May 3rd. The bank informed me that on May 9th a Electronic Transfer 5677 Reference 01299215762 for $203.73 and they have that check. @@@@@@@ To whomever is reading this you will have to call and leave a message to return your call. I am afraid to answer my phone because of them calling me. @@@@@@@@

They call our business literally 3-5 times a day.

Capital One has been calling weekly and as of this week have started calling everyday with the auto-dial system. I have requested that they remove me from their auto-dial multiple times and they have gone from calling every week to everyday. I have told them when I will be making payments and they have told me they will continue to call and can not remove me from their calling list.
