Recognizing Your Debt Collection Rights

If you’re the victim of debt collector harassment or abuse, you have many alternatives. The CFPB is lawfully authorized to investigate any complaints and, if necessary, punish and subject any debt collectors who violate the law. However, they do not act on behalf of one consumer. Instead, they search for a pattern of complaints, and then go after the most egregious offenders.

The second choice is to file a complaint with your state Attorney General, who’s also authorized to take legal action against unlawful debt collectors. Again, though, they do not take individual circumstances. A third alternative is to file a complaint with the Better Business Bureau (BBB). Whereas the BBB isn’t authorized to take any lawful actions, it may serve to warn other customers about certain debt collectors and may also assist with dispute mediation. Lastly, the FDCPA grants consumers who were harassed or otherwise abused by a debt collector that the right to file a civil lawsuit against the collector for around $1,000. Since the law says that debt collectors who violate the law should pay your legal fees, legal representation should not cost you anything out of pocket.
